A DUI arrest represents a big enough problem already. During a traffic stop, you feel the pinch after a law enforcement officer suspects you of driving while drunk.
Now that you are in this situation, you must understand the importance of not making additional mistakes; ones that may get you into further legal trouble.
Incriminating statements and being disrespectful
Here are some mistakes to avoid after a DUI-related traffic stop:
- Talking too much: Making incriminating statements is a must to avoid. Remember, you have the right to remain silent. Be prepared as the arresting officer will ask you a series of questions. Keep you answers short and simple. Do not provide excessive detail. The Miranda warning, though, is usually not read to people arrested for DUI.
- Failing to abide by orders: Do not disobey any order from law enforcement. If an officer instructs you to place your hands on the wheel and remain seated, do so. If he or she asks you to carefully remove your hands from your pockets, do so. If the officer orders you to remain in your vehicle, do not get out.
- Informing the officer of your legal rights: Such an action paints you as a disrespectful know-it-all based on what you learned in a college constitutional law class. Do not explain what you can and cannot do in front of the officer, who already should know your legal rights. You may be setting yourself up for an obstructing a law enforcement officer charge, too.
- Resisting arrest: Please remain quiet and calm. This is no time for belligerence. Listen to the arresting officer, maintain control of your emotions and make mental notes regarding how the arresting officer treated you.
Make sure to remain level-headed and not make any sudden moves that may be interpreted as being hostile.
No need to magnify your problem
Perhaps you made a mistake by having a few drinks after work and then driving home. However, you do not need to worsen your situation by making additional mistakes during a traffic stop for DUI. Pay attention the arresting officer, listen, stay calm and follow orders.
